The new economy’s industries are marked by easy entrance and exit: bright ideas were readily funded, but imitators are just as quick to follow. Additionally, information is expensive to produce but inexpensive to reproduce, a factor that will erode the value of intellectual property rights and reduce the durability of Schumpeterian profits in that sector.
California’s Secretary of Health and Human Services, Mark Ghaly, let the mask (pun intended) slip on December 9 when he admitted that the newly imposed ban on outdoor dining was “not a comment on the relative safety of outdoor dining”, but rather had to do “with the goal of keeping people at home.”
Californians are witnessing the fruits of the Democrats’ relentless determination to control government. After having successfully shoved Republicans off to the fringes, the state has imposed a seemingly endless series of tax hikes, intrusive environmental regulations, and costly mandates on businesses.
With time, the modernist emphasis on increasing knowledge—and the presumption that there is always more knowledge to come—triumphed over traditional emphases on capital, scale, commerce, and trade. But where did that knowledge come from? Whose “ingenuity” was it?
Thomas Sowell points out that while only 10 percent of the traditional public schools he studied had a majority of students passing at the “proficient” level on the mathematics exam, 68 percent of charter schools achieved that level. When it comes to the English test, the numbers are 14 percent and 65 percent respectively.
Within the institutions of entrepreneurship, one should be able to drop down their bucket where they are. Institutions of entrepreneurship should make room for new entrepreneurial participants via technological devices, i.e., smartphones, tablets, laptops. Higher levels of entrepreneurship are not the cause but the effect of technological advancements.
Perhaps the biggest myth to die this year was that Americans’ constitutional rights are safeguarded by the Bill of Rights. After the Covid-19 pandemic began, governors in state after state effectively placed scores of millions of citizens under house arrest – dictates that former Attorney General Bill Barr aptly compared to “the greatest intrusion on civil liberties” since the end of slavery.
As with every other government regulation, a one-size-fits-all policy is crude and unjust and usually causes more harm than good. Hayekian “local knowledge” is needed in order to address this issue and this is something government is most unlikely to be able to provide.

It is never the business of government to regulate business. But it is perfectly acceptable for businesses to regulate the attire and conduct of employees and patrons. Consumers decide if they will go along with them or shop somewhere else. In a free society, the government wouldn’t be involved in any way.
